PowerHost AI Terms of Service

1. Agreement and operator
These Terms govern access to PowerHost AI, a business software service operated by Superhost AI LLC, doing business as Rate Snoop. By creating an account or using PowerHost, you agree to these Terms. If you use PowerHost for a company or property operation, you represent that you are at least 18 years old and can bind that organization.
If you do not agree, do not create an account or use PowerHost.
2. The service
PowerHost provides AI-assisted property operations, shared workspaces, connected-service access, communications, task and procedure management, reporting, image generation, and tools that can prepare or perform actions in authorized systems.
We may improve, replace, suspend, or discontinue features. Some capabilities depend on third-party platforms and may be unavailable when those platforms change or experience an outage.
Features identified as alpha, beta, preview, or pre-release may be incomplete, contain errors, change materially, or be discontinued. Use additional care and maintain appropriate independent records when relying on those features.
3. Accounts, teams, and authority
You must provide accurate account information, protect your credentials, and promptly tell us about suspected unauthorized use. You are responsible for activity under your account and for assigning appropriate workspace roles.
PowerHost workspaces are location-wide. Authorized members of a location may see shared chats, property information, contacts, approvals, and operational history. You must have the rights and permissions needed to add users and to provide owner, guest, property, reservation, message, and other information to the service.
4. Integrations, AI, and operational actions
You authorize PowerHost to access and exchange information with property-management, communications, pricing, and other services you connect, as needed to provide the service and carry out your instructions. You are responsible for maintaining authority to use those accounts and data.
AI output can be incomplete, inaccurate, or unsuitable for a particular situation. PowerHost may draft, recommend, schedule, or execute operational actions through tools. Some actions require approval; others may run automatically under your configuration. Approval controls do not replace your responsibility to review important settings, recipients, dates, amounts, and outcomes.
You remain responsible for property-management decisions, communications, compliance, and actions performed at your direction. PowerHost does not provide legal, tax, accounting, brokerage, insurance, employment, or other professional advice.
5. Acceptable use
You will not use PowerHost to:
- break the law or violate another person's rights;
- submit data, connect systems, or contact people without required authority or consent;
- submit Social Security numbers, complete payment-card or bank account details, medical records, government identification images, or similarly regulated data unless PowerHost expressly supports that use in writing;
- send spam, harassment, deceptive messages, malware, or harmful content;
- use PowerHost as the sole or determinative basis for tenant screening, housing eligibility, employment, credit, insurance, or another legally significant decision about a person;
- publish AI-generated or edited content that materially misrepresents a property, person, communication, or event;
- bypass access controls, probe vulnerabilities, disrupt the service, or access another customer's information;
- reverse engineer or scrape the service except where applicable law does not allow that restriction; or
- use PowerHost or its output to build or train a competing model or service without our written permission.
6. Customer data and privacy
As between you and PowerHost, you retain your rights in information you provide or connect. You authorize PowerHost to process that information as needed to operate, secure, and support the service and carry out your instructions.
Our handling of personal information is described in the Privacy Policy. You are responsible for giving notices and obtaining permissions required for personal information you direct PowerHost to process.
When PowerHost processes personal information in your data on your behalf, you determine the purposes of that processing and PowerHost acts as your service provider or processor to the extent required by applicable law. Any separately signed data processing agreement controls if it conflicts with these Terms.
7. Fees and payment
Paid access is governed by the plan, order, or other pricing terms presented to you. You agree to pay applicable fees and taxes when due. Except where law or written plan terms require otherwise, fees are non-refundable. We may change pricing for a future billing period after reasonable notice.
8. Third-party services
Third-party platforms are governed by their own terms and privacy practices. PowerHost does not control and is not responsible for third-party data, decisions, outages, security, or downstream delivery. You are responsible for reviewing and maintaining your third-party accounts, configurations, and permissions.
9. Ownership and feedback
PowerHost and its licensors own the service, software, designs, documentation, and related intellectual property, excluding your data. These Terms give you a limited, non-exclusive, non-transferable right to use the service for your internal business operations while your account is authorized.
If you provide feedback, you allow us to use it without restriction or compensation, but we will not identify you publicly without permission.
As between you and PowerHost, and to the extent permitted by law, you may use output generated from your use of PowerHost for your business purposes. Output may not be unique, and this permission does not grant rights in third-party materials that may appear in an output.
10. Suspension and termination
You may stop using the service at any time, subject to applicable plan or order terms. We may suspend or terminate access for nonpayment, security risk, unlawful use, material breach, or to protect PowerHost, users, or others. Where practical, we will give notice and an opportunity to resolve the issue.
After termination, access ends and information is handled under the Privacy Policy and applicable legal obligations. Provisions that by their nature should continue—including ownership, payment, disclaimers, liability limits, and dispute terms—survive.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERHOST IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED SERVICE, ACCURATE AI OUTPUT, THIRD-PARTY DATA, OR ANY BUSINESS, REVENUE, OCCUPANCY, GUEST, OR OPERATIONAL RESULT.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERHOST AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID POWERHOST FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so these limits apply only to the extent permitted by law.
13. Indemnification
To the extent permitted by law, you will defend and indemnify PowerHost and its affiliates from third-party claims arising from your data, your connected systems, your instructions or actions, your violation of law or these Terms, or your infringement of another person's rights.
14. Changes to these Terms
We may update these Terms. We will change the effective date and provide additional notice of material changes when required. PowerHost may require you to review and accept updated Terms before continuing to use the service. Where renewed acceptance is not required, continued use after updated Terms take effect means you accept them to the extent permitted by law.
15. Governing law and disputes
North Carolina law governs these Terms, without regard to conflict of laws rules. State and federal courts located in Mecklenburg County, North Carolina have exclusive jurisdiction over disputes, and each party consents to those courts.
These Terms, any applicable order or plan terms, and the Privacy Policy are the entire agreement about the service and replace prior discussions on that subject. If one provision is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or business transfer.
